Yukon Court Rejects Appeal in Sexual Assault Case

The Yukon Court of Appeal has rejected an appeal by a man challenging his sentence for sexual assault. Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020. Following a jury trial, Amin was found guilty of four counts of sexual assault.

Amin promptly appealed his sentence and was granted bail. His appeal sought a reduction of two months from his slightly over two-year sentence to qualify for a conditional sentence order, citing concerns about potential immigration consequences. However, Justice Susan Griffin, in her ruling on August 6, dismissed the appeal. Griffin disagreed with Amin’s assertion that errors were made in his original sentencing and deemed his request for a conditional sentence unsuitable.

Griffin stated that Amin’s plea to shorten his sentence by two months was inappropriate unless he could demonstrate a fundamental error influencing the sentence. She emphasized that such a request amounted to minor adjustments and fell outside the court’s jurisdiction. As a result, Amin will serve his original sentence of just over two years.
