ICE agents have been involved in numerous shootings leading up to the death of Renee Good, a trend that has been noted as the Trump administration pushes the narrative of “absolute immunity” for these agents. The widespread presence of Immigration and Customs Enforcement (ICE) across the United States has stirred tensions within local communities, particularly after the President tasked the agents with executing his aggressive immigration policies. Recent events, including the tragic killing of Ms. Good and another individual in Minnesota, have fueled growing opposition to ICE actions.
The recent turmoil in Minneapolis has brought attention to the issue, shedding light on the fact that ICE agents, who are expected to resort to firearms only as a last measure, have engaged in multiple shootings in the past. Investigations following the Minnesota incidents revealed that ICE agents have been involved in numerous other shooting incidents beyond the Good case. Analysis of various records, including ICE incident data, disclosed that shootings involving moving vehicles occurred at least 19 times.
These vehicle-related shootings resulted in at least 10 fatalities and six injuries, with additional instances where task forces including ICE agents fired at U.S. citizens. Furthermore, it was found that ICE agents fired in public settings with bystanders present on 22 occasions, and in seven cases, the individual shot by an ICE officer was not the target of enforcement action. The ICE guidelines stipulate that force should only be used when all other options to resolve a situation have been exhausted.
While the threshold for prosecuting federal officials is high, ICE agents can still face prosecution if they fail to adhere to this standard, which is applicable across law enforcement agencies. The Department of Homeland Security (DHS), which oversees ICE operations, emphasized that officers are trained to prioritize public and officer safety by using the least amount of force necessary and employing de-escalation techniques.
Despite the accountability standards, agents have often evaded severe consequences due to judicial deference, where judges tend to accept the agents’ subjective beliefs regarding the necessity of using deadly force. The Trump administration has staunchly defended ICE agents involved in shooting incidents, asserting that they should not be subjected to prosecution, with top officials, including Vice President JD Vance, advocating for their “absolute immunity.”
