A significant monetary compensation was awarded to a family following a shocking incident where a woman, previously declared deceased, suddenly showed signs of life when her body bag was opened at a funeral home.
The woman, Timesha Beauchamp, was declared dead in September 2020 after experiencing a medical emergency at her Southfield residence in a Detroit suburb. Despite efforts by paramedics to revive her, which were unsuccessful, a doctor pronounced her dead over the phone based on information provided by the paramedics. Ms. Beauchamp, a 20-year-old with cerebral palsy, was mistakenly declared deceased.
Subsequently, funeral workers witnessed the woman opening her eyes and gasping for air upon arrival at the James H Cole Home for Funerals, leading to accusations of gross negligence against the paramedics. The town of Southfield agreed to compensate the distraught family with $3.25 million (£2.41 million) as a result.
A spokesperson for Southfield addressed the complexity of the case, emphasizing the challenging circumstances posed by the global pandemic. The city expressed remorse for the tragic events and reiterated its commitment to providing top-quality emergency medical services to the community.
Following the incident at the funeral home, Ms. Beauchamp was rushed to the hospital, where she remained on a ventilator until her passing weeks later. The family’s attorney, Steven Hurbis, revealed that the young woman had suffered severe hypoxic brain damage due to prolonged oxygen deprivation before her eventual death in October 2020.
In a statement, the family expressed their deep sorrow over the loss of Timesha, highlighting that this was the second time she had been wrongly declared dead. Legal action was pursued by the family with the assistance of lawyer Geoffrey Fieger, resulting in a settlement reached in December after months of litigation.
Speaking to the Detroit Free Press, Mr. Hurbis mentioned that the family seeks closure and healing after a long and arduous legal battle. Despite the bittersweet nature of the settlement, he emphasized that justice had been served, allowing the family to grieve and find solace.
